Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Tabby Tab mobile application, websites, and related services (collectively, the “Service”) provided by Tabby Tab (“Tabby Tab,” “we,” “us,” or “our”).
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Tabby Tab helps groups split restaurant and bar bills. Users may scan receipts, assign items to participants, calculate each person’s share (including tax and tip), and send payment reminder messages containing a Venmo handle or other payment information.
Tabby Tab is not a bank, payment processor, money transmitter, or financial institution. We do not process payments, hold funds, or access your Venmo account. Any payments are made directly between users through third-party services or other methods they choose.
2. Eligibility
You must be at least 13 years old to use the Service.
If you are under 18, you may use the Service only with the consent and supervision of a parent or legal guardian.
By using the Service, you represent and warrant that you meet these eligibility requirements.
3. Your Account
You may be required to register using a verified phone number.
You agree to:
- Maintain accurate account information.
- Keep your phone number current.
- Protect your device and account credentials.
- Accept responsibility for all activity occurring under your account.
You may delete your account at any time through the app settings. Information about account deletion and data retention is available in our Privacy Policy.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, deceptive, or harmful purpose.
- Upload or share content you do not have the right to use.
- Upload photos or personal information about others without appropriate permission.
- Harass, threaten, impersonate, or abuse other users.
- Send spam or unsolicited communications.
- Attempt to reverse engineer, disrupt, interfere with, scrape, or overload the Service.
- Collect or use personal information about other users without their consent.
We may suspend or terminate accounts that violate these Terms.
5. Receipt Scanning and Calculations
Receipt scanning, item recognition, and bill calculations are automated processes and may not always be accurate.
You are responsible for reviewing receipt data, item assignments, tax, tip calculations, and payment requests before sharing them with others. Tabby Tab is not responsible for disputes arising from incorrect assignments or calculations.
6. User Content
You retain ownership of all photos, receipts, and other content you upload to the Service (“User Content”).
By uploading User Content, you grant Tabby Tab a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display that content solely for the purpose of operating, improving, and providing the Service.
You represent and warrant that:
- You own or have the necessary rights to your User Content.
- Your User Content does not violate applicable laws or the rights of any third party.
- Your User Content complies with these Terms.
7. Sharing Tabs and Payment Requests
When you add participants to a tab or send payment reminders, certain information may be shared with others involved in the bill, including:
- Names
- Phone numbers
- Assigned amounts
- Optional receipt or item information
Shared links may allow recipients to view bill information through a web browser for a limited period.
You are responsible for ensuring that information is shared only with individuals who are legitimately involved in the transaction.
8. Social Features
The Service may include optional social features such as friend requests, activity feeds, or shared dining history.
You control certain visibility settings through the app. We reserve the right to remove content, disable features, or restrict accounts that violate these Terms.
9. Third-Party Services
The Service relies on third-party providers for functionality such as authentication, cloud storage, messaging, analytics, and receipt processing.
Your use of third-party services may be subject to their separate terms and privacy policies.
Venmo, Apple Messages, and other third-party platforms are independent services and are not controlled by Tabby Tab.
10. Service Availability
We strive to provide a reliable Service but do not guarantee uninterrupted availability.
The Service is provided on an “as is” and “as available” basis. We may modify, suspend, discontinue, or remove features at any time without liability.
11. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express, implied, statutory, or otherwise.
We specifically disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free.
- Receipt scans or calculations will be accurate.
- Any shared links, notifications, or messages will be delivered successfully.
12. Limitation of Liability
To the fullest extent permitted by law, Tabby Tab and its affiliates, officers, employees, contractors, and licensors shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, data, goodwill, or business opportunities.
This limitation applies whether the claim arises in contract, tort, negligence, strict liability, or otherwise.
Without limiting the foregoing, Tabby Tab is not responsible for disputes between users regarding bill amounts, payment obligations, reimbursement, or collection of funds.
Our total aggregate liability for any claim relating to the Service shall not exceed the greater of:
(a) the amount you paid to Tabby Tab during the twelve (12) months preceding the event giving rise to the claim; or
(b) fifty U.S. dollars (US $50).
13. Indemnification
You agree to defend, indemnify, and hold harmless Tabby Tab and its affiliates, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of:
- Your use of the Service.
- Your User Content.
- Your violation of these Terms.
- Your violation of any law or third-party right.
14. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we may provide notice through the Service or require acceptance of the updated Terms before continued use.
Your continued use of the Service after updated Terms become effective constitutes acceptance of those changes.
15. Termination
You may stop using the Service at any time.
We may suspend, restrict, or terminate your access to the Service at any time if we believe you have violated these Terms or if we discontinue the Service.
Sections that by their nature should survive termination will remain in effect after termination.
16. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Nothing in these Terms limits any consumer protection rights that may apply under the laws of your jurisdiction.
